Personal Training Agreement and Release of Liability

This Agreement is entered into by and between My Live Trainers, LLC (MLT) and the undersigned client (“Client,” “You,” “Your,” or “Buyer”) as of the date below. By signing this Agreement, you agree to purchase training services from MLT under the terms and conditions outlined here.

Price: $1 for the initial 14-Day Fat Melt Program.
Billing Date: Monthly anniversary of signing date.

Agreement and Acknowledgements:

By signing this Agreement, you acknowledge that you have read, understood, and agreed to all terms and conditions, including the Authorization for Automatic Payment, Agreement to Arbitrate Disputes, Acknowledgement & Assumption of Risk, and Limitation of Liability & Full Release of MLT. You confirm that you have had the opportunity to review this Agreement with an attorney at your discretion.

This Agreement constitutes the entire understanding between you and MLT. MLT makes no warranties or representations beyond what is explicitly stated here. Any disputes or conflicts between this Agreement and any copies shall be resolved in favor of the original Agreement.

Additional Terms:

Account Freeze: You may freeze your account at any time by notifying MLT and paying a freeze fee of 30% of the Monthly Training Fee.
Termination: You may terminate this Agreement at any time by providing written notice via registered or certified mail, or by email. Upon termination, you may continue to use the services for thirty (30) days from the last billing date, after which any unused sessions will be forfeited.
Electronic Transactions: By entering into this Agreement, you consent to conduct business electronically, including the use of electronic contracts and signatures.

Client’s Rights:

3-Day Right to Cancel: You have the right to cancel this contract within three (3) operating days of receiving a copy of this Agreement.
No Refunds: All sales are final, and no refunds will be issued.
Minors: If you are under 18, this Agreement must be signed by a parent or legal guardian.

Governing Law:

This Agreement shall be governed and enforced in accordance with the laws of the state of New Jersey.

Acknowledgment and Assumption of Risk:

Client acknowledges that the services purchased hereunder include participation in strenuous physical activities, including but not limited to aerobic dance, weight-training, stationary bicycling, various aerobic conditioning machinery, and various nutritional programs offered by MLT (the “Physical Activities”).

Client acknowledges that these Physical Activities involve the inherent risk of physical injuries or other damages, including but not limited to heart attacks, muscle strains, tears, broken bones, shin splints, illness, soreness, or injury however caused, occurring during or after participation in the Physical Activities.

Client further acknowledges that such risks include, but are not limited to, injuries caused by the negligence of an instructor or other person, defective or improperly used equipment, overexertion, slip-and-fall incidents, or an unknown health problem.

The client fully understands the importance and relevance of all the risks and expressly and voluntarily agrees to assume all risks and responsibilities involved with participation in the Physical Activities, including but not limited to:

Training, exercise, aerobics, aerobic conditioning and training
Weight training, circuit training, cardiovascular exercise and training
Use of machinery, training equipment, free weights, circuit machinery, and cardiovascular machines
Stretching, weight lifting, and testing (including but not limited to testing of cardiovascular system, heart rate, muscle strength, endurance, and flexibility)
Any other training activities, techniques, and/or exercises.

The client expressly and voluntarily assumes any and all risks associated with participation in the Physical Activities, including but not limited to:

Dizziness, strains and/or sprains, fractures of any kind
Syncope (fainting), arrhythmia (alteration in heart rhythm), dyspnea (shortness of breath), angina pectoris (chest pain)
Tachycardia (rapid resting heart rate over 100 beats per minute), myocardial infarction (heart attack), cerebrovascular accident (stroke)
Dysrhythmia (abnormal rhythm of brain waves or heart rhythm), and/or any other physical injury, due to any cause whatsoever.

The client affirms that they are in good physical condition and do not suffer from any disability, condition, impairment, disease, infirmity, or illness that would prevent or limit participation in Physical Activities.

The client acknowledges that participation will be physically and mentally challenging and agrees that it is their responsibility to seek competent medical or other professional advice regarding any concerns or questions about their ability to take part in the Physical Activities.

The client certifies that they have been informed of the need for a physician’s approval for participation in the Physical Activities under this Agreement. By signing this agreement, the client asserts that they are capable of participating in the activities.

The client certifies that MLT has recommended that they have a yearly or more frequent physical examination and consultation with their physician regarding physical activity, exercise, and the use of exercise and training equipment so that they may have knowledge that they have either:

(a) Been given permission by their physician to participate, or
(b) Decided to participate in the Physical Activities defined hereunder without the approval of their physician.

The client certifies that they have given full and complete disclosure to MLT of all physical conditions, impairments, diseases, infirmities, or illnesses that might affect or prevent participation in the Physical Activities.

The client represents that they have no congenital, physical, or mental health problems, no underlying cardiovascular, neurological, or any illness, or condition which might affect or prevent participation in the Physical Activities under the Agreement.

The client agrees to assume all risk and responsibility for exceeding their physical limits. The client enters into the Agreement with full knowledge of all the risks and benefits associated with the Physical Activities.

The client further agrees to follow all rules set forth by MLT and its trainers, agents, contractors, and/or workmen.

Limitation of Liability and Full Release of MLT:

You, for yourself, your heirs, assigns, administrators, executors, and family members, fully waive, release, and discharge MLT, its owners, employees, affiliates, and independent contractors from any and all claims or liabilities arising from your participation in the services provided. This includes, but is not limited to, injuries, disability, or death, regardless of whether such claims arise from negligence or fault of MLT or its agents.

This release covers all claims, including but not limited to those arising from physical activities, nutritional programs, or any other services provided by MLT. You understand that this is a comprehensive release of liability, and you agree that it is binding and enforceable under applicable law.

Arbitration Agreement:

In the event of any dispute between you and MLT, both parties agree to resolve the dispute through binding arbitration, as outlined in this Agreement.

Additional Sessions:

Any additional sessions provided are based on your commitment to complete the Initial Term and are not earned until all payments for the Initial Term are completed.

Use of Client’s Likeness/Image:

By signing this Agreement, you permit MLT to use your likeness and/or images for promotional purposes unless you revoke this authorization by providing written notice.

Final Acknowledgements:

You agree that all program and training sales are non-refundable and non-transferable. By signing below, you confirm your understanding and agreement with all terms outlined in this Agreement.
